Discuss ongoing situation with legal cases in view of news of SBI pushing for Insolvency Process of JAL.
Proceedings of hearing of Allahabad High Court on 29 Sep 2022 was briefed by Sunil Kumar Sharma to all as AHC ordered JAL to put on record of court by way of affidavit, their proposal to liquidate liabilities of Homebuyers, Banks and YEIDA, and copy of same shall be served to all parties, including homebuyers to respond to. Court also asked JAL to deposit Rs. 100 Crore in account of YEIDA as a precondition to consider proposal of JAL.
It has been widely published in news papers that SBI has filed application in NCLT for Insolvency of JAL, which is expected to be attached with previously filed application by ICICI Bank.

Approval of engagement of local counsel from Adv. Anoop Trivedi’s office for Rs. 50,000/.
In order to avoid confusion between Local Counsel appointed by Adv. Lokesh Bhola and Office of Adv. Anoop Trivedi, it was decided and approved by all that another Local Counsel be appointed from Mr. Trivedi’s office itself as Mr, Anoop Trivedi is now expected to lead the hearing and Adv. Lokesh be retained as back up, as well as his Local Counsel, Adv. Pushkar Mehrotra.

Approval of holding joint conference of all advocates engaged by homebuyers for bringing all on same page and chalk out strategy after filing of affidavit by JAL as per court order dated 29.09.2022 for which homebuyers shall file reply before next date on 09th Nov 2022. Approval of expense to pay for Conference Charges of Adv. Anoop Trivedi.
It was discussed and agreed by all that a conference be held involving all advocates, namely Adv. Anoop Trivedi, Adv. Anuj Bhandari, Adv. Kartikey Saran, Adv. Lokesh Bhola, and Adv. Abhishek Kumar Singh and Adv. Chakit Singhal of society committee, after JAL has filed the affidavit, so same can be discussed and appropriate reply be filed with knowledge of all and in best possible manner. Conference Charges of Adv. Anoop Trivedi of upper limit of Rs. 35,000/- is approved and Mr. Sunil Sharma is requested to negotiate if possible.

Discuss cooperation with Beetle Lap Home Buyers Association, whose project has been granted Completion Certificate by YEIDA without actual amenities.
This issue was not discussed due to paucity of time and shall be carried forward to next meeting.
5.
Waiving off of Membership Renewal Fee of members who has paid at least membership fee 1 time and Legal Fund Contribution.
It was discussed and agreed that Governing Body cannot waive off the Annual Membership Fee as it is specified in byelaws of the society and is mandatory to be paid unless approved in General Body Meeting of Society with approval of at least 2/3rd members.
But as Society does not wish to let membership of members be terminated due to nonpayment of renewal fee only; a minor delay penalty shall be applicable. As there is no rule of delay penalty in byelaws of the society, President of Society has recommended to formulate below rule, as per powers given to him, in byelaws of society, (Rule 8 – Rights and Responsibilities of President – “Where rules are silent, President is authorized to make rules and take decision in the interest of society”)
Delay Penalty Rule, effective from 5th October 2022
1. Every member whose membership is due for renewal has 3 months’ time to pay prescribed Annual Membership Renewal fee from the due date, without any delay penalty.
From 4th month onwards there shall be a delay penalty of Rs. 25 per month.
2. This rule will be applicable to only those members who have contributed at least Rs 5000/- which is Rs 4000 towards Legal Fund Contribution and Rs 1000 for first year’s Membership Fee.
3. President may decide to suspend this rule, in circumstances of needs of society, and demand all dues of society be paid immediately or within a duration decided by President by way of notice and upon nonpayment of dues, Society shall terminate the membership of the member, without any further notice.
6.
Termination of members who have not paid Legal Contribution Fee and their 1-year membership is expired.
It was agreed and decided that all such members who have not paid Legal Fund Contribution of Society as on 5th October 2022, be sent Final Notice for payment within 2 weeks, after which their membership shall be terminated, and their names removed from the list of members of society from Registrar Office
