Allahabad High Court (Both Cases), NCDRC ongoing group cases filed as Representative Suits and RERA cases filed individually by members as well as Grouped case of Kassia. Impact of these litigations and strategise these to benefit homebuyers and deny any possible benefits to builder. Implications of affidavit filed by JAL in AHC and how to handle the possible outcomes in next hearing. |
Mr. Sunil Sharma briefed on status of cases. RERA matter of Kassia for Sec 7 and Sec 8, there is no action by Secretary U P RERA after it was forwarded to him by RERA Member.
In NCDRC, 2 Cases of Section 12.1.C has reached final hearing and should be decided finally by Mid 2022.
Both AHC cases are linked now, JAL has filed affidavit and YEIDA has files Counter Affidavit, copies of which are been shared to all members in groups.
Mr. Sunil Sharma suggested to hire a Designated Senior Advocated in Allahabad High Court so homebuyers case can be put forward more strongly in Final Arguments stage and to seek some interim releif. |

Hiring of Designated Senior Advocate for ongoing case in AHC for putting the Society case points strongly during hearing and approval of budget of upto Rs. 75,000 to 100,000/- per hearing for Designated Senior Advocate for upto 4 hearings. |
EXCOM agreed to hire the senior advocate for ongoing case in AHC for putting the points more strongly in front of AHC Bench for the cause of homebuyers and Mr. Sunil Sharma was permitted to seek a Designated Senior Advocate and engage prior to next hearing at Allahabad High Court. |
