| 1. | Review Action Points of meeting dated 28 October 2020
1.1 Formation of Sub-committees for focused actions for identified goals of society going forward 1.2 Calendar of Events of Society 1.3 Submission of list of new members to Registrar of Society at Meerut |
1.1 It was discussed and decided to create four sub committees as follows
a. Legal Committee – to handle legal matters b. Media Committee – to increase media presence c. Liasion Committee – for liasion with YEIDA, JAL and others d. Membership Committee – to create awareness and reach out to more home buyers Each of the committee will be headed by one or two of the Executive Committee members and more members from society will be encouraged to join with qualification in respective area and availability of their time to contribute to society 1.2 Calendar of important dates and meetings will be prepared and published on society website within two weeks, highlighting important dates where certain activities needs to take place 1.3 This matter has been delayed due to COVID situation and now due to blockade by farmers on access roads and it will be taken up at earliest opportune time |
| 2. | Review of Legal Cases and if any updates | a) AHC Lease Cancellation case – There have been cues that matter might be settled between Jaypee and YEIDA out of court, though High Court has yet not given the date where our IA can be taken on record. We are still waiting for HC to give a date
b) SC case of 64% extra compensation to Farmers – Date is fixed for 15th December for hearing this matter and we hope issue will be decided in a single date c) Jaypee Infratech NCLT Case – Matter of return of Rs 750 Crore of JAL from SC was heard on 8th October 2020 and order was reserved. NBCC has insisted to be given this 750 Cr but SC has indicated that this money is of JAL and Jaypee lawyer has said in court that this money has to be used to complete housing projects of JAL so we are awaiting a detailed order of court. Though there are indications that NBCC might back out and Jaypee Infratech might be back with Jaypee |
| 3. | Review of memberships and financial statements of society | Current membership of society is 190 members. Bank balance of society till date is Rs. 7,69,570/- out of which Rs. 6,00,000/- is parked as fixed deposit |
| 4. | Discussion on Society opening dialogue with YEIDA and Jaypee for working out solution for homebuyers | YEIDA has declined to hold meeting because of ongoing legal cases and efforts are being made with Mr. Sunil Sharma to open dialogue with Jaypee officials with a list of questions sent in advance. Awaiting confirmation from the end of Jaypee |
| 5. | Discussion on newspaper report of ICICI Bank led consortium proposing to do out of court settlement of NCLT Insolvency case and its impact on home buyers | As facts of assets and liabilities are not available to us especially how these will be divided in new restructuring and where will Jaypee Sports City be placed, it is difficult to do anything and a meeting with Jaypee is a way to get some information. Also it is quite evident, as in JAL homebuyers are in minority position as creditors compared to banks, it might be difficult to achieve anything except a delay. Matter has to be pursued to gather more information and discuss it again |
| 6. | Considering the proposal of a member of society, Mrs. Maya Srivastava to file separate writ at Allahabad High Court. | As suggested by Maya Srivastava ji, matter was discussed and Mr. Sunil Sharma has been in touch with AHC senior advocate A C Srivastava, who after consultation with other lawyers has suggested to file a separate Writ of its own by the society in order to have a chance of early hearing at Allahabad High Court. Members discussed and agreed that it is better to see some conclusion on Lease Cancellation Case and 64% extra compensation case. If our matter is not heard in present IA, we can go for separate writ |
| 7. | Publishing paid newspaper article/notice to create awareness regarding Society and the plight of homebuyers of JPSC | Matter was discussed and Treasurer Mr. Bobby Kalra and Executive Member Mr. Amit Garg are tasked with exploring costs and content for this activity by means of Google Ads, Facebook Ads and News Paper Ads |
| 8. | Any other matter | It was discussed to assign Mr. Moher Singh, Executive Member with duties and responsibilities of General Secretary of Society till further notice as Mr. Rajiev Malhotra, present General Secretary has been caught up in personal business matters and cited of lack of availability of time |
