| 1. | Finalization of Law Firm for Fresh Writ in AHC | Discussion held for finalization of Pricus Legal Law Firm (Adv. Mr. Anuj & Adv. Manorath Rathee) for Fresh writ in AHC.
Sunil Sharma requested to meet with other two lawyers from Allahabad refered by Adv. Abhishek so that we don’t have to necessary employ a Delhi Lawyer, who in turn will then hire a legal counsel. Consensus could not be reached as members were of opinion that we have already met two advocates and search and interview for more lawyers will delay the filing of writ and it was then agreed to go ahead with Pricus Legal. Mr. Maurya Ji clarified that whatever decision taken in GBM with majority must be ownered and accepted by all. Those decision is not questionable at later stage. If anybody have doubt or concern same shall be raised and clarified at the point of discussion. All 7 members agreed to file the Fresh Writ through M/s Pricus Law Firm. Further it was agreed that Mr. Amit will arrange the revised commercial Quotation from M/s Pricus considering the stage (3 stages) payment to minimize the commercial risk. After receiving the revised quotation all members must read carefully and provide the observations on proposal to finalize the terms and condition with law Firm. Final quotation Must be signed by all members to avoid any argument at later stage for terms and conditions. |
| Media reports of YEIDA reinstating lease of Jaypee Sports City Land and future of Writ C 6049/2020 at Allahabad High Court where150 members of society are impleaded as respondants vide order date 8th February 2021. | Mr.Sunil Sharma brought the issue that Media has reported through various newspapers that CEO of YEIDA has given statement in Media that they have sent a proposal to board of YEIDA with recomputed and restructuring of dues of JAL and lease of Jaypee Sports City land may be reinstated back to JAL.
Bobby Kalra and others has raised apprehensions that if JAL and YEIDA will agree to settle their dues by this proposal due to be approved by Board of YEIDA and later accepted by JAL, then the matter at Allahabad High Court will be withdrawn by petitioner JAL, and matter will be dismissed by court without hearing homebuyers. Bobby Kalra then stated that if we are not heard at AHC because of JAL’s withdrawal, we should approach Supreme Court to be heard. Sunil Sharma then apprised that as per his discussion with Lokesh Bhola, this is a possibility and if home buyers need to be heard then we can challenge the order of Allahabad High Court dated 1st March 2021, which was passed in absence of Advocates of Homebuyers and without giving them an opportunity to be heard, even though we were respondents in the matter on date, and request Supreme Court to vacate that order till homebuyers are heard. This will make it compulsory for Allahabad High Court to fix a date and hear homebuyers without passing any further order and stopping JAL to withdraw the matter. Rajiev Malhotra and Amit Garg suggested that while we areappointing Pricus Legal for fresh writ, this issue shall also be put in front of them and let them advise, what needs to be done. All agreed on this course of action and requested Mr. Amit Garg to discuss with Pricus Legal on the issue and advise best course of action. This matter requires urgent attention as any delay can mean possibility of withdrawal of Writ by JAL and dismissal of existing case. |
