An urgent meeting of governing body was called up on by issuing notice through WhatsApp/ Telegram messages by Mr. Moher Singh and Agenda of the Meeting and the decisions taken are as below:

| 1. | Discussion on Fresh Writ to be filed at Allahabad High Court representing homebuyers for insufficient action of state of UP and YEIDA for securing rights of homebuyers. | Matter was brought up initially by Mr. Sunil Kumar Sharma, who has come in touch with Advocate Gaurav Agarwal and in an initial meeting Advocate Gaurav Agrawal has recommended to file separate fresh Writ by Homebuyers as present Impleadment Application might not secure relief in all of our prayers and court might not take action against builder as homebuyers are Respondents and only limited prayer might be heard, limited to matter of reinstatement of lease of land to builder.
Matter was then brought up-to attention of Governing Body and second meeting with Advocate Gaurav Agarwal was arranged through Zoom Meeting 26th May, which was attended by Sunil Sharma, R P Maurya, Rajiev Malhotra, Bobby Kalra, Chakit Singhal and others. Adv. Gaurav has again recommended the same and various questions were asked to him and he has answered these questions. Matter was then discussed in WhatsApp Chats and again in this meeting. Most members in meeting were convinced that a fresh writ shall be filed at Allahabad High Court though Advocate Abhishek has advised that Writ might not stick at Allahabad High Court as other recourse to lower courts of RERA, specifically legislated to deal with real estate issues is yet not taken up by society and Allahabad High Court might send society to RERA for litigation or resolution. At the same time, he recommended that limited risk can be taken to approach AHC to try it but shall not risk huge amounts of fee/expenses in litigation. Mr. Moher Singh and Mr. Rajiev Malhotra were asked to speak further with Advocate Gaurav and seek his quotation for handling the matter. |
| 2. | Discussion on arranging Reconciliation Meeting to be arranged through RERA, with JAL and YEIDA. | Mr. Sunil Sharma brought to everyone’s attention regarding his meeting with officials of RERA, which happened through RERA Samvaad channel, an initiative of UP RERA to resolve issues of homebuyers in UP. Mr. Sunil Sharma apprised group that 2 months back he has registered on UP RERA portal as individual and has sought appointment in RERA Samvaad initiative for which he received response on 27th May 2021 for meeting on 28th May 2021 in morning. Meeting was attended by Sunil Sharma, and it was also attended by Chairman Rajiev Kumar, Joint Sec and Sec of RERA were in meeting. As per them, they are aware of situation, and the matter in Allahabad High Court. Chief Conciliation Officer, R D Paliwal confirmed that Jaypee has already applied to start construction on projects on same lines as Kalypso Court and Knights Court and if homebuyers also come onboard, they will help in bringing YEIDA CEO for taking the matter forward. He asked me to send an email, in this matter and arrange meeting with Jaypee, YEIDA, RERA and Association of Homebuyers. Sunil Sharma had updated them on matter of Allahabad High Court as well as number of members we have in Association, and he asked me that I shall write email as association and to propose resolution in this direction. Above was discussed by members and it was agreed that an email shall be sent to RERA for seeking this meeting and possibly there is good sign that things may move forward with RERA. Sunil Sharma confirmed that he will be sending the Email on behalf of society to arrange reconciliation meeting and all members agreed for the same. |
